This will be the first inspection since the merger of KB Life and Prudential Life last year. Additionally, the FSS is set to conduct thematic examinations on three large General Agencies (GAs) starting in October, focusing on specific issues such as improper replacement contracts.



KB Life Insurance's Upcoming Regular Inspection

KB Life Insurance, formed from the merger of KB Life and Prudential Life in January of last year, is scheduled to undergo its first regular inspection by the Financial Supervisory Service (FSS). This inspection, anticipated to take place in September, will be the first since the company's formation and is expected to be thorough given its significance. Regular inspections by the FSS are typically conducted every 2 to 5 years and cover critical aspects of insurance operations including financial soundness, internal controls, and consumer protection.

The inspection will review KB Life’s operations post-merger, assessing whether the integration has been effectively managed and if internal controls are adequately in place. The focus will likely be on evaluating how well the company has adapted to new regulatory and operational requirements since the merger.


Thematic Examinations for General Agencies (GAs)

In addition to the regular inspection, the FSS will also conduct thematic examinations on large GAs starting in October. This move comes as part of the FSS’s initiative to strengthen regular inspections of major GAs with over 3,000 agents. Previously, companies such as Global Financial Sales and GA Korea have completed their regular inspections. In October, Inca Financial Services will undergo its inspection.

The FSS aims to address internal controls, improper sales practices, undue commission payments, replacement contracts, and compliance with the Financial Consumer Protection Act during these inspections. Special attention will be given to issues like inadequate internal controls and improper sales practices.

Thematic Inspection Focus

The FSS has announced plans for thematic inspections in October, with a particular focus on improper replacement contracts. Although there was speculation that the inspections might target specific types of insurance, the FSS has decided to prioritize the issue of improper replacement contracts, reflecting growing concerns in the industry.

Thematic inspections are conducted periodically and focus on specific issues or trends. This approach allows the FSS to address emerging problems and enforce compliance with industry standards more effectively.

Industry Concerns

Industry experts have noted that the FSS’s thematic inspections, especially those focusing on improper replacement contracts and undue commission payments, could lead to significant fines. The FSS’s scrutiny in these areas is expected to be intense, given the high stakes involved in compliance with the Financial Consumer Protection Act and other regulations.

An industry professional commented, “The FSS may base its inspection decisions on filed complaints and preliminary data, leading to in-depth investigations of specific issues. The most concerning aspect for the industry is the potential for substantial fines related to violations of the Financial Consumer Protection Act.”
